What did his doctor told him about the possible diagnosis and following treatment? Did he and you followed his advice strictly?
All this will become important if you think his doctor may have committed malpractice and both of you are willing to start the legal proceedings.

I did include a link to the American legal eagle.Yes I think the doctor should have done a test instead of just a visual, not all doctors can tell what herpes is just by looking at it. I also think your doctor gave the wrong diagnosis. Every case of herpes can look different and some times herpes can look like little pimples.
Testing takes time, costs money and can put one under extreme emotional stress. But those are not excuses not to test. Most of the time if you don't ask the doctor to test for herpes they won't do it.
If you contracted herpes and he is your only sexual partner then most likely he has herpes. You can contract herpes from your partner even if they are showing no signs of an out break, it's less likely to happen it's still possible.
If you want to get a second opinion and ask the doctor to test him for herpes if he ever has another out break. They can also do a blood test for herpes but if you test too early then it may not give you reliable results, a blood test should be done 3-6 months after being "exposed" to herpes.
