Who & how do I sell a FDA Approved Herbal herpes medicine to?

Who & how do I sell a FDA Approved Herbal herpes medicine to?

herbs (if not combined with drugs) are not regulated or approved by the FDA like drugs are. However the FDA can pull the remedies off the shelves or raid your warehouse if they feel that the remedy is being promoted in a way that can harm someone or if they get complaints that the remedy has caused a health problem. You may not actually claim that it will cure any disease or it will raise a red flag at FDA. You have to read the FDA regulations on selling and manufacturing herbal remedies, or ask an established seller of herbal remedies for advice.Yeah, the first thing you might want to check out is are the Federal DSHEA laws - because if you say the FDA has approved anything herbal for the treatment of herpes, those are the laws that are going to bite you in the butt.

If you say that something "treats" a condition - you are making a drug claim - you'll need an expensive lawyer for that.

"A conventional food label or labeling may bear statements about a substance's effect on the structure or function of the body provided such statements do not claim to diagnose, mitigate, treat, cure, or prevent disease and are not false or misleading. Additionally, the claimed effect must be achieved through nutritive value.. In the preamble to the final rule governing structure/function claims on dietary supplements (65 FR 1000 at 1034; January 6, 2000), FDA stated that the agency is likely to interpret the dividing line between structure/function claims and disease claims in a similar manner for conventional foods as for dietary supplements. As a legal matter, a structure/function claim on a food that is not achieved through nutritive value, or a claim that a food will treat or mitigate disease, subjects the product to regulation as a drug under section 201(g)(1) of the Act."

I'm sorry you got suckered into that scheme. I would stop now before you plow too much money into it and lose even more. Because I assure you, the FDA did NOT approve an herbal herpes medication.

Herpes zoster (HZ) develops in 10-30% of patients infected with varicella-zoster virus (VZV). A decline in cell-mediated immunity is believed to be important in the reactivation of this virus. Since varicella vaccine became available, the incidence of natural varicella infection has declined by 75-80%. Lack of exposure to natural infection eliminates a source of immunity boosting, and there has been concern that rates of HZ would consequently increase.
